Agreement to Terms

By installing, activating, or using Hush Touch, you agree to these Terms of Service and the End User License Agreement (EULA) below. If you do not agree, do not install or use the software.

These terms govern your use of the Hush Touch desktop application and the website at hushtouch.com. For details on what data we collect and your privacy rights, see our Privacy Policy.

If you obtained Hush Touch from the macOS App Store, your use is also governed by Apple's Licensed Application End User License Agreement (Standard EULA). To the extent the two conflict for App Store users, Apple's Standard EULA controls.

License Grant & Restrictions

1. License Grant

Hush Touch grants you a non-exclusive, non-transferable license to install and use the software on up to three (3) devices that you own or control, for personal or commercial use.

2. Ownership

The software is licensed, not sold. Hush Touch retains all intellectual property rights in the software, including all copies, modifications, and derivative works.

3. Restrictions

You may not:

• Reverse engineer, decompile, or disassemble the software, except where this restriction is expressly prohibited by applicable EU law (Directive 2009/24/EC)
• Modify, adapt, or create derivative works
• Redistribute, sublicense, rent, or lease the software
• Remove or alter any proprietary notices
• Use the software for any unlawful purpose

4. License Key & Device Limit

Each license key activates on a maximum of three devices. You can deactivate a device from the in-app Settings to free up an activation slot. We may revoke or invalidate license keys obtained through fraud, chargebacks, or violation of these terms.

Subscriptions & Billing

Plans Offered

• Monthly — Recurring billing every month. Cancel anytime.
• Yearly — Recurring billing every 12 months. Cancel anytime.
• Lifetime — One-time payment. No recurring charges.

Automatic Renewal

Monthly and yearly subscriptions renew automatically at the end of each billing period using your stored payment method. Pricing in effect at the time of renewal applies. We will email you in advance of any material price change with enough notice to cancel before the change takes effect.

Managing or Cancelling Your Subscription

You can cancel, update your payment method, or download invoices at any time:

1. Go to hushtouch.com/manage.
2. Enter your purchase email and license key to open the secure Stripe Customer Portal.
3. Choose Cancel Subscription. Cancellation takes effect at the end of the current paid period — you retain access until then.

If you can't open the portal, email hush@hushtouch.com from your purchase address and we'll cancel on your behalf.

Failed Payments

If a renewal payment fails, we'll retry the charge and notify you by email. If payment cannot be collected after our retry window, your license will be deactivated until billing is restored.

Lifetime Licenses

Lifetime licenses are a one-time purchase with no recurring charges and include free updates for the lifetime of the product. "Lifetime" means the operational lifetime of Hush Touch; it does not create an obligation to maintain the product indefinitely.

Refund Policy

Direct Purchases (hushtouch.com)

• Unactivated licenses: Full refund available within 14 days of purchase. Email hush@hushtouch.com from the purchase address.
• Subscriptions: You can cancel at any time at hushtouch.com/manage. We do not generally refund partial billing periods after activation, but contact us if you believe a refund is warranted.
• Technical issues: If a defect prevents the software from working and we cannot resolve it, contact us and we will work with you on a resolution, which may include a refund.

App Store Purchases

App Store purchases are subject to Apple's refund policy. Submit refund requests at reportaproblem.apple.com. We cannot process refunds on Apple's behalf for App Store purchases, but we are happy to help with technical issues at hush@hushtouch.com.

EU Consumer Rights

14-Day Right of Withdrawal

If you are a consumer in the European Union or European Economic Area, you have a 14-day right of withdrawal from the date of purchase under the EU Consumer Rights Directive (2011/83/EU).

Important: By purchasing and downloading the software, you expressly consent to the immediate delivery of digital content and acknowledge that you lose your right of withdrawal once the license key has been delivered and the download or activation has begun, in accordance with Article 16(m) of the Consumer Rights Directive.

If you have not yet activated your license key, you may request a full refund within 14 days of purchase by emailing hush@hushtouch.com.

Online Dispute Resolution

EU consumers may also use the European Commission's Online Dispute Resolution platform.

Warranties & Limitation of Liability

Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT.

For consumers in the EU/EEA: This disclaimer does not affect your statutory rights under applicable consumer protection laws, including the right to a product that conforms to the contract description and is fit for its intended purpose.

Limitation of Liability

IN NO EVENT SHALL HUSH TOUCH BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

For consumers in the EU/EEA: This limitation does not exclude or limit liability for (a) death or personal injury caused by negligence, (b) fraud or fraudulent misrepresentation, or (c) any liability that cannot be excluded or limited under applicable EU/EEA law.

Termination

This license is effective until terminated. Your rights under this license will terminate automatically if you fail to comply with any of its terms. Upon termination, you must delete all copies of the software.

Governing Law & Updates

Governing Law & Dispute Resolution

• EU/EEA consumers: These terms are governed by the laws of your country of residence. You may bring proceedings in the courts of your country of residence. Nothing in these terms affects your rights under mandatory EU consumer protection laws.
• All other users: These terms shall be governed by the laws of the United States, without regard to conflict of law principles.

Updates to Terms

We may update these terms from time to time. We will notify users of material changes via email or in-app notice. Continued use of the software after changes constitutes acceptance of the new terms. The date at the top of this page indicates the last update.

Severability

If any provision of these terms is found to be unenforceable or invalid under applicable law (including EU/EEA consumer protection law), the remaining provisions will continue in full force and effect.
